The Lagos High Court in Ikeja has dismissed the application filed by Mr. Joseph Aloba, father of the late singer Mohbad, seeking to challenge the legal advice of the Director of Public Prosecutions (DPP) which led to the release of Naira Marley, Sam Larry, and others previously linked to Mohbad’s death.
Justice Taiwo Olatokun ruled that the Attorney General acted within his lawful powers and that those powers, exercised through the DPP, could not be legally questioned. The judge emphasized that no relief could be granted as the application lacked merit.
Despite the setback, Mr. Aloba, who was present in court with supporters, vowed to appeal the decision. His lawyer, renowned SAN Wahab Shittu, argued the DPP’s advice pre-empted the Coroner’s inquest, which is still ongoing. They also cited lack of fair hearing and alleged that key suspects were released prematurely.
However, the DPP’s office clarified that the suspects were not acquitted but discharged due to lack of evidence directly linking them to Mohbad’s death.
The case continues to draw national attention as the fight for justice for Mohbad presses on.
